EU: Malta has not updated its air pollution programme
Not yet checked Not yet checked
The claim
“Commission calls on Member States to update their national air pollution control programmes (NAPCP) to reduce the emissions of certain atmospheric pollutants.”
European Commission (July 2025 infringements package, 17 Jul 2025): the Commission opened infringement procedures against Malta (INFR(2025)2088) and five other Member States, saying that 'to date, these Member States have not submitted to the Commission the required updates' of their national air pollution control programmes (NAPCP) under Directive 2016/2284 (the NEC Directive), which must be updated at least every four years.

Context
A letter of formal notice is not a finding of breach by the Court. Malta's response and any later reasoned opinion or closure were not found; the October 2026 package (reported by LNB News as naming Malta) has not been read for this case. ERA published an air quality plan (see CC-034). Whether Malta has since submitted an updated programme is the first thing to check.
Limitations
Candidate from the weekly intake of 18 Oct 2026. The statement is 15 months old at intake, older than the usual 60 days, kept because it is a standing legal position whose status can change and be checked. A letter of formal notice states the Commission's view, not a ruling. Related to CC-034, CC-035 and CC-007 in subject (air).
What it will be tested against
Commission infringement decisions register (INFR(2025)2088 status: closed, reasoned opinion or open); ERA / Ministry for the Environment national air pollution control programme and its submission date to the Commission (EEA Reportnet NAPCP repository); Directive 2016/2284 Article 6; EEA NECD emission inventories for Malta against 2020 and 2030 commitments.

The claim. Entry on the NEC Directive read on 18 Oct 2026 (HTTP 200). A letter of formal notice is the first stage; Malta had two months to respond. Later stages for Malta not yet found.

Linked directly 3
Claims that share a theme with this one. A theme is a cause, a mechanism, a target or a way of presenting figures that the editors have found in several claims; its strength says how close the link is.
EU findings of unmet obligations Shared mechanism · Weak (indicative)
Commission documents record Malta missing an EU environmental obligation: water-permit controls (CC-101), recycling targets (CC-117), the river basin plan timetable (CC-128) and the update of the air pollution control programme (CC-129). Indicative until a report tests what each finding rests on and whether it has since been closed.
